§ 133.03 NARCOTIC AND HALLUCINOGENIC DRUGS; DRUG PARAPHERNALIA.
   (A)   Definition. The definition of NARCOTIC DRUGS set forth in F.S. Ch. 893 shall include the following drugs:
      (1)   Lysergic acid (LSD).
      (2)   Mescaline--chemical derived from the Peyote cactus.
      (3)   Psilocybin--derived from the Mexican mushroom.
      (4)   Dimethlytryptamine (DMT).
      (5)   Morning glory seeds.
      (6)   Ololiuquic seeds.
      (7)   PCP.
      (8)   STP.
      (9)   Other drugs which cause hallucinogenic reactions.

   (B)   Adoption of state law. The provisions of F.S. Chapter 893 are adopted and incorporated by reference as though fully set forth herein, except as modified herein.

   (C)   Regulation of paraphernalia.
      (1)   Sale or display. The sale and display of narcotic and other paraphernalia, devices, contrivances, and instruments for the smoking or injection of marijuana, hashish, PCP, or any controlled substance, or the displaying or offering for sale, gift, or delivery of such devices to minors, shall be strictly regulated in accordance with this section. This section shall be known as the "Paraphernalia Regulation Regulations."
      (2)   Allowing Minors on Premises. No owner, manager, proprietor, operator, or other person involved in or employed at any place of business selling or displaying for the purpose of sale, any device, contrivance, instrument, or paraphernalia for smoking, injecting, or consuming marijuana, hashish, PCP, or any controlled substance as defined now or hereinafter defined in F.S. Ch. 893 other than prescription drugs, and devices to ingest prescription drugs, as well as roach clips, cigarette papers, and rollers designed for the smoking of the foregoing, shall allow or permit any person under the age of 18 years to be, remain in, enter, or visit that room unless the minor person is accompanied by one of his or her parents, or by his or her legal guardian.
      (3)   Minors Going on Premises Restricted. It shall be a violation of this section for a person under the age of 18 years to be, remain in, enter, or visit any room in any place used for the sale or displaying for sale, devices, contrivances, instruments, or paraphernalia for smoking or injecting marijuana, hashish, PCP, or any controlled substance, other than prescription drugs and devices; to ingest or inject prescription drugs, including roach clips and cigarette papers and rollers designed and used for smoking the foregoing, unless that person is accompanied by one of his or her parents, or his or her legal guardian.
      (4)   Separate Room Required. In any place of business to which the public is invited, the display for sale, or the offering for sale, of devices, contrivances, instruments, or paraphernalia for smoking or injecting marijuana, hashish, PCP, or any controlled substance, other than prescription drugs, and devices to ingest or inject prescription drugs, including roach clips, cigarette papers, and rollers designed and used for smoking the foregoing, a separate room or enclosure shall be maintained for this purpose from which minors not accompanied by a parent or legal guardian, shall be absolutely excluded. Each entrance to such a room shall be sign-posted in reasonably visible and legible words to the effect that narcotic paraphernalia are being offered for sale in the room and minors are excluded from the room unless accompanied by a parent or legal guardian.
      (5)   (a)   Violations; penalty. Any individual found guilty of violating this section, whether that individual is an adult or a minor as defined herein, shall be guilty of a punishable violation and shall be subject to punishment in accordance with § 133.99.

         (b)   Any person who shall sell, possess, purchase, transfer, use, manufacture, compound, produce, or prepare any of the aforementioned drugs or the drugs set forth in F.S. Chapter 893, and not subject to the exceptions provided therein, shall be guilty of a punishable violation and upon conviction thereof, shall be punished as provided in § 133.99.
