4-2-4: IMPOUNDMENT, REDEMPTION AND DISPOSITION PROCEDURES:
   A.   Impoundment Authority: It shall be the duty of the Chief of Police to seize and impound all cattle, horses, mules, sheep, goats and swine running at large, or herded, picketed or staked out upon any street, sidewalk or any other public place within the corporate limits of the City; provided however, that cattle, horses, mules, sheep, goats or swine may be driven along the following streets while passing through the corporate limits of the City, or driven to the corral now built or constructed on the north side of the railroad track passing through the City: along Fifth Street from its intersection with the north boundary line of the City to its intersection with the south boundary line on Garfield Drive from the east boundary line to the west boundary.    B.   Notice Of Impoundment: When any head of livestock hereinabove enumerated shall have been impounded by the Chief of Police as hereinabove provided, he shall forthwith give notice by posting said notice in at least four (4) public places in the City, which notices shall contain a description of said animal or animals so seized by him, and giving marks and brands, if any, the date when the same was seized and the time and place when they will be sold to satisfy the penalty and charges thereon. Said notices must be posted not less than four (4) days before such sale, and no sale shall be made before the expiration of five (5) days from the date of the seizure of the animal or animals to be sold. When the name of the owner of such animal or animals is known to the Chief of Police, he shall give personal notice to the owner either by serving the notice personally or by placing a written notice in the Post Office, properly addressed to such person, at the same time as or before.    C.   Redemption Of Impounded Animals: At any time before the sale of any animal impounded as above provided, the owner of such animal shall be entitled to the possession thereof upon the payment to the Chief of Police of the penalty above provided together with the expenses incident to the taking up and caring for such animal; and for all payments made as above provided, the Chief of Police shall issue to the party paying a receipt signed by him stating the amount paid and briefly giving a description of the stock for the redemption of which the payment was made and the date when the animal redeemed was seized.    D.   Sale Of Impounded Animals: If any animal taken up and impounded as above provided shall remain unclaimed until the time fixed for the sale, or if claimed and the penalty, charges and expenses have not been paid thereon, the Chief of Police shall, at the time specified in the notice mentioned in subsection B of this section, sell such animal at public auction to the highest bidder at the place specified in such notice. Upon the sale of such animal, the Chief of Police shall issue a certificate to the purchaser showing the date of sale, briefly describing the animal sold and the amount for which sold, and the date when the animal so sold was seized.    E.   Disposition Of Funds; Records: All monies received by the Chief of Police for the sale or redemption of stock must be paid to the City Treasurer on or before the first day of the month next following the receipt of such money by said Chief of Police, and at the same time, the Chief of Police shall file with such Treasurer a detailed statement showing the number of head of stock impounded, the number redeemed and the number sold and the amounts received for redemption and sale separately. In the statement showing the return of sales, each animal sold shall be separately described in such a manner as to exhibit the name of the owner if known, amount of penalty, charges and expenses chargeable against the animal; and should it appear that the amount received is greater than such gross sum of penalty, expenses and charges, the City Treasurer shall hold the excess as a special deposit to be paid to the owner of such animal upon demand and proof of ownership, or right of possession of such animal, at any time prior to the expiration of three (3) months from the date of sale. If claim be not made for any such special deposit within three (3) months, the City Treasurer shall place the money in the treasury for the use of the City. (1975 Code § 5-306)
The statement or statements rendered by the Chief of Police and filed with the City Treasurer shall be retained by the said Treasurer and by him kept on file as a record of the matter, as other records of City transactions are kept. (1975 Code § 5-308)
