§ 945.04 ACCUMULATION OF REFUSE.
   (a)   It shall be unlawful for any person to cause or to permit the accumulation of refuse in or upon premises owned, occupied, or used by them, when and if in the judgment of the County Health Officer such accumulation is unsightly, unsanitary or hazardous to the property, life, health, safety, or welfare of the public.
   (b)   It shall be unlawful to deliver refuse to or upon private property.
   (c)   It shall be unlawful for any person to throw, place, or scatter any garbage, rubbish, trash, or other refuse over or upon any premises, street or alley, river or stream, either public or private, or adjacent thereto, either with or without the intent to liter, remove or burn, or to suffer or permit, from the accumulation of refuse, any premises owned, occupied, or controlled by such persons, to become or remain offensive, unsanitary, unsafe to public health, or hazardous from fire.
   (d)   It shall be unlawful for any person to store or permit the storage of refuse on or about their premises, or the premises occupied by them, unless such refuse is kept in suitable containers.
   (e)   It shall be unlawful for any municipal employee to collect or remove, at the city’s expense, any refuse from the premises of any person or tenant thereof, unless such refuse is kept stored in such containers.
   (f)   It shall be unlawful for any municipal employee to collect or remove, at the city’s expense, any refuse from the premises of any person, or tenant thereof, unless such service has been paid for in full by the person occupying said premises.
   (g)   It shall be unlawful for any person who without authorization dumps garbage or trash, or assists in the unauthorized dumping of garbage or trash, in a dumpster or other solid waste container which is located on the property of another person and leased or otherwise owned or maintained by another person is guilty of a misdemeanor and, upon conviction thereof, shall be punished in accordance with § 945.99 of this article. The act of throwing isolated objects into a dumpster or other solid waste container in the prevention or elimination of litter is specifically accepted from any penalties under this section.
   (h)   The City Council or the Mayor shall have the right to issue, promulgate and establish such rules and regulations as shall be deemed necessary or proper to the effective administration of this article and not inconsistent therewith, including the right to prescribe the place at which refuse containers shall be placed, so as to facilitate the collection and removal of refuse.
   (i)   The Mayor or other duly authorized officer, with the approval of the City Council, shall have the right to establish rates for the collection of refuse or garbage under the provisions of this article where no specific rate is provided therein, or where the collection thereof requires services different from those ordinarily provided under the terms of this article.
   (j)   The City Council reserves the right, by a proper order of resolution, to provide for the disposal of garbage by any practical means open to them.
