§ 945.99 PENALTY.
   (a)   Any person violating any of the provision of this article or failing, or refusing to abide by and comply with the rules or regulations promulgated to effectuate the provisions of this article, convicted of a misdemeanor under this article, shall be subject to the following penalties.
      (1)   Upon a first conviction under this section, the defendant shall be fined not less than $50 nor more than $250.
      (2)   Upon a second conviction under this section, the defendant shall be fined not less than $250 nor more than $500.
      (3)   Upon any subsequent conviction in excess of a second conviction under this section, the defendant shall be fined not less than $500 nor more than $1,000, or imprisoned in jail not less than 30 days nor more than 60 days, or both fined and imprisoned.
   (b)   Each succeeding day a violation of this article exists shall constitute a new and separate offense.
