§ 945.01 DEFINITIONS.
   For the purpose of this article, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   COUNTY HEALTH OFFICER. The County Health Officer of Tucker County.
   PERSON(S). Any individual, partnership, firm, or corporation.
   PRIVATE SCAVENGER. One who for hire, collects, removes or disposes of refuse.
   REFUSE. All sweeping, cleaning, trash, rubbish, litter, garbage, industrial or domestic wastes; fruit or other vegetable matter from the kitchen or dining room; accumulated waste materials or substances which may become nuisances, some of which are more particularly as follows.
      (1)   PREPARED GARBAGE. Waste material from kitchens, dining rooms and similar places, from which liquids have been drained and solid matter wrapped in paper.
      (2)   RAW GARBAGE. Swill not prepared as in division (1) above.
      (3)   TRASH. Waste matter containing no putrid matter or organic wastes.
   REFUSE COLLECTION. The gathering of refuse containers and their contents from the premises of improved property and loading contents into removal vehicles, and returning containers to place where found after contents have been emptied, for which the charge is made as provided for in § 945.03(a) of this article.
   REFUSE CONTAINERS. The trash and garbage containers referred to in this article shall meet the following specifications:
      (1)   Standard containers for the storage of refuse shall be made of leakproof material with a tight fitting lid or cover and shall have a capacity not to exceed 30 gallons, any container having a capacity over 20 gallons shall have the carrying handles, but any container of less than 20-gallon capacity may be equipped with an adequate bail carrying handle; and
      (2)   The Mayor or other proper officer of the Division of Sanitation may authorize or direct the use of such other or special containers as the circumstances of any particular situation may require.
   REFUSE DISPOSITION. The disposition of refuse in accordance with rules and regulations promulgated by the Mayor with approval of the City Council.
   REFUSE REMOVAL. The hauling and transportation of refuse from point of collection to point of disposal.
