3-3-8: DENIAL OF LICENSE:
   A.   Upon the review of the application by the chief, the city may refuse to issue a license to the applicant under this chapter for any of the following reasons:
      1.   The location and time of solicitation or peddling would endanger the safety and welfare of the peddlers, solicitors or their customers;
      2.   An investigation reveals that the applicant falsified information on the application;
      3.   The applicant has been convicted of a felony, misdemeanor or ordinance violation involving trafficking in controlled substances, or any violent acts against persons or property, such conviction being entered within the five (5) years immediately preceding the date of application;
      4.   The applicant has been convicted of a felony, misdemeanor or ordinance violation involving a sex offense at any time prior to the application for the license;
      5.   The applicant is a person against whom a judgment based upon, or conviction for, fraud, deceit or misrepresentation has been entered within the five (5) years immediately preceding the date of application;
      6.   There is no proof as to the authority of the applicant to serve as an agent of the principal;
      7.   The applicant has been denied a license under this chapter within the immediate past year, unless the applicant can and does show to the satisfaction of the city clerk that the reasons for such earlier denial no longer exist; or
      8.   The applicant fails to submit the necessary information as requested under section 3-3-4 of this chapter and/or the application is incomplete.
   B.   The chief's disapproval and the reasons for disapproval shall be noted on the application, and the applicant shall be notified by the chief that his application is disapproved and that no license will be issued. The applicant shall also be notified of the appeal rights set forth in section 3-3-13 of this chapter. Notice shall be mailed to the applicant at the address shown on the application form, or at the applicant's last known address. (Ord. 573, 12-9-2014)
