1-3-2: DEFINITIONS, GENERAL:
Whenever the following terms are used in this Code, they shall have such meanings herein ascribed to them, unless the context makes such meanings repugnant thereto:
   AGENT A person acting on behalf of another.
   CITY The City of Parma, County of Canyon, State of Idaho.
   CODE The Municipal Code of the City of Parma.
   DAY Any twenty four (24) hour period from midnight to midnight.
   EMPLOYEES Whenever reference is made in this Code to a City employee by title only, this shall be construed as though followed by the words "of the City of Parma".
   ENFORCING OFFICER Whenever in this Code it is provided that anything must be done, to the approval of or subject to the direction of the enforcing officer, this shall be construed to give such officer only the power to determine whether the rules and regulations established in this Code have been complied with and shall not be construed as giving such officer discretionary powers.
   FEE A sum of money charged by the City for the carrying on of a business, profession or occupation.
   INFRACTION A civil public offense, not constituting a crime, punishable by a penalty not exceeding one hundred dollars ($100.00) and for which no incarceration may be imposed. 1
   KNOWINGLY Imports only a knowledge that the facts exist which bring the act or omission within the provisions of this Code. It does not require any knowledge of the unlawfulness of such act or omission.
   LAND, REAL ESTATE, and REAL PROPERTY Includes lands, tenements, hereditaments, water rights, possessory rights and claims.
   LICENSE The permission granted for the carrying on of a business, profession or occupation.
   MISDEMEANOR Any offense not defined as a felony or infraction under State law. 2 Except in cases where a different punishment is prescribed by the Idaho Code or by this City Code, a misdemeanor is punishable by imprisonment in a County jail not exceeding six (6) months or by a fine not exceeding three hundred dollars ($300.00), or both. 3
   MONTH A calendar month unless otherwise expressed.
   NEGLECT, NEGLIGENCE, NEGLIGENT and NEGLIGENTLY Imports a want of such attention to the nature or probable consequences of the act or omission as a prudent man ordinarily bestows in acting in his own concern.
   NUISANCE Anything offensive or obnoxious to the health and welfare of the inhabitants of the City; or any act or thing repugnant to, or creating a hazard to, or having a detrimental effect on the property of another person or to the community.
   OATH Includes "affirmation", and the word "swear" includes the word "affirm". Every mode of oral statement under oath or affirmation is embraced in the term "testify" and every written one in the term "depose".
   OCCUPANT As applied to a building or land, shall include any person who occupies the whole or any part of such building or land whether alone or with others.
   OFFENSE Any act forbidden by any provision of this Code or the omission of any act required by the provisions of this Code.
   OFFICER Includes officers and boards in charge of departments and the members of such boards and such references as use of the word "Municipality" shall mean this City "Clerk" or "Treasurer" and others shall mean the City Clerk or City Treasurer as the case may be applicable.
   OFFICERS Whenever reference is made in this Code to a City officer by title only, this shall be construed as though followed by the words "of the City of Parma".
   OFFICIAL TIME Standard Time or Daylight Saving Time as may be in current use within the Municipality.
   OPERATOR The person who is in charge of any operation, business or profession.
   OWNER As applied to a building or land, shall include any part owner, joint owner, tenant in common, joint tenant or lessee of the whole or of a part of such building or land.
   PERSON Any public or private corporation, firm, partnership, association, organization, government or any other group acting as a unit, as well as a natural person.
   PERSONAL PROPERTY Includes every description of money, goods, chattels, effects, evidence of rights in action and all written instruments by which any pecuniary obligation, right or title to property is created, acknowledged, transferred, increased, defeated, discharged or diminished and every right or interest therein.
   PROPERTY Includes both real and personal property.
   PUBLIC THOROUGHFARE Includes streets, alleys, lanes, courts, boulevards, public ways, public squares, public places and sidewalks.
   QUARTER Any three (3) month period, ending with the last day of March, June, September and December.
   RETAILER Unless otherwise specifically defined, shall be understood to relate to the sale of goods, merchandise, articles or things in small quantities directly to the consumer.
   RIGHT OF WAY The privilege of the immediate use of the roadway or other property.
   SHALL/MAY "Shall" is mandatory, "may" is discretionary.
   SIGNATURE Includes any name, mark or sign written with the intent to authenticate any instrument of writing.
   STREET Includes alleys, lanes, courts, boulevards, public ways, public squares, public places and sidewalks.
   TENANT As applied to a building or land, includes any person who occupies the whole or any part of such building or land, whether alone or with others.
   WHOLESALER The terms "wholesaler" and "wholesale dealer" as used in this Code, unless otherwise specifically defined, shall be understood to relate to the sale of goods, merchandise, articles or things in quantity to persons who purchase for the purpose of resale.
   WILFULLY When applied to the intent with which an act is done or omitted, implies simply a purpose or willingness to commit the act or make the omission referred to. It does not require any intent to violate law or injure another or to acquire an advantage.
   WRITTEN, IN WRITING May include printing and any other mode of representing words and letters, but when the Written, in Writing (cont.) written signature of any person is required by the law to any official or public writing or bond, it shall be in the proper handwriting of such person, or in case he is unable to write, by his proper mark.
   YEAR Any one calendar year unless otherwise expressed. (1959 Code §1-103; 1990 Code)
