These regulations shall apply to the subdividing/development of land within the corporate limits of the city including the property within Parma's area of impact, or as mutually defined by both the city and county under the requirements of Idaho Code section 67-6526, and shall include the following:
A. Filing Of Plat: The subdivision of a tract of land into two (2) or more lots, parcels or sites for transfer of ownership or development, whether immediate or future. Any subdivision of said tract will require the filing of a plat in accordance with the provisions of this title. All of such lots, parcels or sites created pursuant to this title shall front upon a public street unless otherwise specifically approved by the council after recommendation of the commission.
B. Dedication Of Streets Or Alleys: The dedication of any street or alley through or along any tract of land, except where such dedication is initiated at the request of a public body.
C. Resubdivision: The resubdivision of a parcel of land into more than one parcel except as provided in the exceptions listed in subsection E of this section.
D. Development Of Condominium Projects:
1. In condominium projects, as permitted by Idaho Code, the commission and council may regulate and attach conditions to the design concepts and location of buildings, the creation, shape and size of condominium units, the provisions and maintenance of open space, and off street parking. Unless excepted pursuant to the provisions of this chapter, the commission and council shall require the installation of public improvements and utilities for condominium projects as required under the provisions of this chapter.
2. For purposes of the administration of subdivision regulations, the commission may consider a condominium development as a single building, requiring one front yard, two (2) side yards, a rear yard and other regulations pertinent to a given lot; and may grant such exceptions as are necessary to the subdivision regulations to permit such development.
E. Exceptions: Exceptions to the regulations of this title shall include the following:
1. A readjustment of lot lines which does not reduce the area, width, depth or building setback lines below the minimum required.
2. An allocation of land in the settlement of an estate or a court decree for the distribution of property thereunder with the stipulation that the land may not be divided into more than four (4) parcels with a minimum size per parcel to be five (5) acres.
3. The unwilling sale of land as a result of legal condemnation as defined and allowed in Idaho Code and when the dedication of a right of way for public purposes is initiated by a public body.
4. The acquisition of street rights of way by a public agency.
5. The exchange of land for the purpose of straightening property boundaries which does not result in the change of the present land usage. (Ord. 541, 2-26-2007)
