5-2-8: HOME OCCUPATIONS:
   A.   It shall be unlawful for any person to engage in a "home occupation" as defined in section 5-2-5 of this chapter within the city without having first received a permit therefor.
   B.   Application for a home occupation permit shall be in writing, signed to and sworn to by the resident or the property owner upon application forms furnished by the city.
   C.   The permit fee imposed and collected shall be as set by council and may be issued for the term of the home occupation but shall not be transferable from one individual or property owner to another. Home occupation permits shall meet all of the following terms and conditions:
      1.   The use is clearly incidental and secondary to the use of the dwelling for dwelling purposes.
      2.   The use is conducted entirely within a dwelling and is carried on by the inhabitants thereof.
      3.   No article shall be sold or offered for sale on the premises, except such as is produced by the occupant on the premises. Any illegal articles or goods sold or offered for sale on the premises such as stolen property or any form of contraband shall be strictly prohibited.
      4.   The use does not change the character of the dwelling or adversely affect the uses permitted in the zoning districts.
      5.   The use requires no additional off street parking spaces.
      6.   No persons are employed other than those necessary for domestic purposes.
      7.   Not more than one-fourth (1/4) of the gross area of the one floor of said dwelling is used for such use.
   D.   A home occupation permit may be revoked if it is determined that any of the conditions of this section are being violated. Prior to any revocation, the applicant shall be afforded an opportunity for a hearing before the commission, said hearing must be requested within seven (7) days of receipt of a notice of intent to revoke a home occupation permit. Failure to request such a hearing will result in revocation of the home occupation permit. (Ord. 527, 3-14-2005)
