§ 93.13  PUBLIC TREE CARE.
   (A)   This chapter provides the Urban Forestry Committee with full power and authority over all matters regarding trees, plants and shrubs located within street rights-of-way, parks and public places of the city.
   (B)   The Urban Forestry Committee may remove or order to be removed, any trees or parts thereof which are in an unsafe condition, due to factors such as disease, insect infestation or trauma.  This section does not prohibit the planting of boulevard trees by adjacent property owners providing that the selection and location of the trees is in accordance with §§ 93.08 through 93.13 of this chapter and with approval of the City Forester. The city shall have the right to plant, prune, maintain and remove all trees, plants, and shrubs within the rights-of-way of all city streets, alleys, avenues, lanes, squares and public grounds as may be necessary to insure public safety or to preserve or enhance public symmetry and beauty of the public grounds.
   (C)   For the removal of public trees, the cost will be shared by the city and landowner on a 50% basis.
