9-1-1: GENERAL PROVISIONS:
   A.   Enforcement Officer; Authority: The terms "building official" or "administrative authority" when used in this title or in any publication adopted by reference in this title shall mean the office of the building official; provided, however, that the town manager may appoint such deputies as needed to perform any inspection work or other functions that may be required by this title or the regulatory publications adopted herein. The administrative authority, as such may be referenced in any section of this title or any regulatory publications adopted herein, for all matters pertaining to any building, plumbing, electrical or any other inspections, shall be vested in the office of the town building official. The town building official shall have the authority to develop licensing, construction and inspection procedures which may be recommended to the council and which, upon approval by resolution, shall become the licensing, construction and inspection procedure of the town.
   B.   Penalty For Violation Of Codes: Any person, firm or corporation violating any of the provisions of the building code, the residential code, the plumbing code, the electrical code, the mechanical code, the fuel gas code, the fire code, the energy conservation code, the existing building code, the property maintenance code or in any publication or regulatory code adopted by reference in this title shall be guilty of a class one misdemeanor, and upon conviction thereof shall be punished by a fine of not more than two thousand five hundred dollars ($2,500.00) or by imprisonment in the county jail for not more than six (6) months, or by both such fine and imprisonment.
