8-2-5: LIMITATIONS ON ISSUANCE OF PERMIT:
   A.   No permit required pursuant to section 8-2-1 of this chapter shall be issued to any person other than a contractor, duly licensed by the state pursuant to the provisions of Arizona Revised Statutes title 32, the state of Arizona, a political subdivision of the state or a federally recognized Indian tribe.    B.   No permit shall be issued for the excavation of newly paved or resurfaced streets, sidewalks, curbs and or gutters for a period of two (2) years from the date upon which such work was completed and accepted by the town. The public works director shall keep and maintain records showing the date upon which work described in this subsection was accepted by the town for the purpose of administering this subsection. However, the public works director may declare an emergency and waive the two (2) year limitation. (1988 Code § 7-7-2; amd. 2004 Code)
   C.   Notwithstanding the provisions of subsection B of this section, construction operations involving boring under a newly paved or resurfaced street, sidewalk, curb or gutter are authorized, and a permit may issue for such activities.
   D.   Notwithstanding the provisions of subsection B of this section, in cases where existing utility service has been unexpectedly discontinued, such repairs as are necessary to restore service may be made; provided, that:
      1.   The director of public works is notified the next business day of the circumstances and location of the emergency repairs;
      2.   A permit is applied for at the same time the director of public works is notified; and
      3.   Such emergency work is performed pursuant to the standards and conditions provided for in this chapter. (1988 Code § 7-7-2)
