6-6-3: REMOVAL FROM PRIVATE PROPERTY:
   A.   Notice To Remove: If it is determined by the town that graffiti exists on property in violation of this chapter, the town shall, in writing, notify the owner of the property or the responsible party through the issuance of a notice of violation providing a maximum of ten (10) days to abate the graffiti which may be served by certified mail, personal service, or by posting the affected property and publishing the notice in the local newspaper. The notice of violation shall identify the property in violation, shall generally describe the location of the graffiti, and shall direct that the graffiti shall be abated within ten (10) days of receipt of the notice. The notice shall state that in the event the owner or responsible party fails to abate the graffiti within the time period specified in the notice of violation, the town shall abate the graffiti and bill the owner or responsible party for the costs thereof. The notice shall state that the owner or responsible party may appeal the notice to the town clerk by filing a written notice of appeal with the town clerk within ten (10) days of the violation notice, accompanied with an appeal fee as established by resolution of the town council.    B.   Abatement By Town; Costs:
      1.   Town To Abate; Costs To Owner: In the event that the owner or responsible party fails to abate the graffiti as required by the notice of violation, the town may proceed to abate the graffiti and bill the owner or the responsible party for the costs thereof. In the event that the bill is not paid, a statement of account shall be certified by the chief fiscal officer who shall collect the same due, together with any interest at the rate established by law.
      2.   Authority To Abate; Entry Powers: The town or its authorized contractor is expressly authorized to enter onto private property and abate graffiti thereon in accordance with this chapter. The town police department shall assist the code enforcement officer in the enforcement of this chapter. (1988 Code § 10-1-7)
