A. Any person found guilty of violating any provisions of this code, except as otherwise provided in this code, shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not to exceed one thousand dollars ($1,000.00) or by imprisonment for a period not to exceed six (6) months, or by both such fine and imprisonment.
B. Any violation of or failure or refusal to do or perform any act required by title 7 of this code constitutes a civil traffic violation. Civil traffic violations are subject to the provisions of title 28, chapter 5, articles 2 and 4, Arizona Revised Statutes, and amendments thereto.
C. Any person violating any provisions of this Code that are designated as subject to civil penalty shall be punished by imposition of a fine not to exceed $500.00, unless another penalty is specified.
D. In addition to the penalties herein provided, any condition caused or permitted to exist in violation of any of the provisions of this Code or any Town ordinance will be deemed a public nuisance and may be abated by the Town as provided by law. Imposition of the penalties in this Chapter will not prevent the revocation of a license, permit, or franchise.
E. Each day that any violation of any provision of this Code or Town ordinance continues constitutes a separate offense.
F. Recidivism.
1. The recidivist process is designed to provide relief via an expedited enforcement process for problems with persons or entities who repeatedly violate any provision of this Code or Town ordinance and who have demonstrated an unwillingness to comply with this Code.
2. Any civil citations issued after the responsible party has been found responsible for two or more violations of this Code or Town ordinance within the previous eighteen months, whether by admission, payment of a fine, or by default judgement, are punishable by a class 1 misdemeanor.
