(A) Pool location. All swimming pools installed on residential property within the city shall conform to the following requirements.
(1) All setback and side yard requirements shall be measured to the edge of the water surface of the pool.
(2) Side yard requirements shall be as follows:
(a) Lots of less than 1 acre: 15 feet; or
(b) Lots of 1 acre and greater: 30 feet.
(3) Rear setback requirements shall be as follows:
(a) Lots of less than 1 acre: 15 feet; or
(b) Lots of 1 acre and greater: 30 feet.
(4) The pool shall be located to the rear of the rear building line of the principal residence; provided, however, in the event the principal residence is irregular shaped, such as an L- or U-shaped home, a portion of the pool may be inside (to the front of the lot) the rear building line, so long as the pool is screened from the street by the principal residence.
(5) All pool equipment shall be screened from the street and adjoining properties, with screening materials approved by the city at the time of application for a building permit. All pool equipment shall be located in the side or rear yard of the residence, behind the front building line.
(6) All provisions relative to construction of swimming pools contained in the building, plumbing, electrical, and other codes adopted by the city shall be complied with in the construction of any pool, decking, equipment, and required fencing.
(B) Permits. A building permit must be obtained for the construction of swimming pools within the city. Plans for the pool, developed in conformity with this section, proposed screening materials for the equipment, and a filing fee established by the city shall be required prior to the issuance of a building permit.
