12-402.   Repair and Replacement in All Other Areas.
   A.   The Director of the Street Department shall annually inspect all sidewalks. The Director shall develop a priority list of areas needing repair. Repairs scheduled from said list shall be subject to the approval of the City Manager and the annual budget appropriations by the Commission. Such improvements shall be subject to a 50% - 50% cost sharing between the City and the property owner.
   B.   In the event that certain sections of sidewalk need to be repaired as a result of a substantial construction failure or to abate a serious safety hazard then the City shall repair said sidewalk. "Substantial construction failure" shall refer to conditions wherein certain facilities fail to function for their intended purpose within a substantially shorter time frame than would normally be anticipated, and shall not refer to what might be considered normal deterioration from age and/or prolonged use. Such improvements shall be subject to a 50% - 50% cost sharing between the city and the property owner.
   C.   Improvements made at the initiation of the property owner shall be at the expense of the property owner (Ord. #845, 02/03/94).
