The following words, terms, and phrases, when used in this Chapter, shall have the meanings ascribed to them in this section, except when the context clearly indicates a different meaning. The word "shall" is always mandatory and not merely directory.
(1) "Yard sale" means and includes all general sales, open to the public, conducted from or on any premises in any residential or non-residential area for the purpose of disposing of personal property, including but not limited to all sales entitled "yard", "garage", "lawn", "attic", "porch", "room", "backyard", "patio", "flea market", "rummage", or any other similar type worded sale. This definition does not include the operation of any business carried on, on a regular day to day basis, at a fixed location, in a Business District allowed and regulated by the City of Paris Zoning Ordinance as is set out in Chapter 11 of the Paris Municipal Code where such business has a business license, sales tax number, and meets all building and code requirements.
(2) "Person" shall include individuals, neighborhood associations, and non-profit organizations as classified by the internal revenue service. Recognized clubs and organizations of schools, churches, and civic service organizations shall be considered a person for the purposes of this Ordinance. Final determination of the status of such clubs and organizations, in the event of a dispute, shall be made by the City Manager.
(3) "Personal property" means property that is owned, utilized, and maintained by an individual or members of an individual's residence and acquired in the normal course of living in or maintaining a residence. It does not include merchandise purchased for resale or obtained on consignment. Such personal property includes goods, wares, merchandise, household articles, utensils, jewelry, clothing, furniture, and other articles of this kind acquired as a function of daily living and not acquired for the purpose of inclusion in a yard sale.
