§ 40.206 PARKING ON PRIVATE PROPERTY
   (A)   Definition. For the purpose of this section, the following definitions shall apply unless the context indicates or clearly requires a different meaning.
   “PRIVATE PARKING LOT.” Includes any lot owned by a business or industry and used as a parking lot for its employees, customers, or other persons stopping there for the purpose of doing business with or soliciting business from any business or industry for whom the lot is provided.
   “SIDEWALK.” That portion of a street between the curblines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians, including any strip of ground between the curb and paved sidewalk.
   (B)   It shall be illegal for the operator of any vehicle to park a vehicle for any time upon any private property in the city, including any private parking lot, without the consent of the owner or lessee.
   (C)   It shall be unlawful for any person to park a vehicle, trailer, or boat within the front yard or side yard of any residential structure except upon a residential driveway. It shall also be unlawful for a person owning, possessing, managing, or controlling residential property to allow the parking of vehicles, trailers, or boats within the front yard or side yard of such premises except upon an approved residential driveway.
   (D)   It shall be unlawful for any person to park a vehicle, trailer, or boat upon a sidewalk.
   (E)   The consent mentioned in subsection (B) may be expressed or implied but shall not be implied on private parking lots for nonemployees parking there for any other purpose than the above listed purposes for which the lot is provided.
   (F)   Any person may petition the Code Enforcement Board for a waiver of these regulations. The Code Enforcement Board may grant an annual permit to the applicant and may attach any reasonable conditions concerning buffers or other pertinent improvements to lessen the effect on neighboring properties if, and only if, the Code Enforcement Board finds that as a result of the physical conditions of the property, it is not practical to park a vehicle, trailer, or boat in the manner set forth above.
   (G)   Any police officer or citation officer is authorized to issue citations for violations of this section.
   (D)   Operators violating this section shall be subject to a fine as provided in § 40.700 and to tow away as provided in § 40.703.
