§ 33.45 OPIOID SETTLEMENT FUNDS—RESTRICTED AND UNRESTRICTED.
   (A)   Established. There is established a special fund known as Opioid Settlement Fund—Unrestricted (Fund 2256) (the “Unrestricted Fund”) and the Opioid Settlement Fund—Restricted (Fund 2257) (the “Restricted Fund”).
   (B)   Contributions to the Unrestricted Fund. Contributions to the Unrestricted Fund shall be the unrestricted portion of opioid settlement funds received from the State of Indiana by the town as a participating political subdivision from a national settlement with Johnson & Johnson, AmerisourceBergen, Cardinal Health and McKesson.
   (C)   Use of Unrestricted Funds. Expenditures may be made from the Unrestricted Fund by appropriation by the Town Council for any purpose approved by the Town Council.
   (D)   Contributions to the Restricted Fund. Contributions to the Restricted Fund shall be the restricted portion of opioid settlement funds received from the State of Indiana by the town as a participating political subdivision from a national settlement with Johnson & Johnson, AmerisourceBergen, Cardinal Health and McKesson.    (E)   Use of Restricted Funds. Expenditures may be made from the Restricted Fund by appropriation by the Town Council for any purpose approved by the Town Council from the List of Permitted Categories of restricted spending issued by the Indiana Office of the Attorney General in accordance with the settlement agreement from the courts.
   (F)   Termination. The Unrestricted Fund and Restricted Fund shall be perpetual funds until terminated by future ordinance, and any funds remaining at time of termination shall be returned to general fund of the town.
