For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ALL-TERRAIN VEHICLES (ATV). Every motorized, off-highway vehicle that:
(1) Is 50 inches or less in width;
(2) Has a dry weight of 1,200 pounds or less;
(3) Is designed for travel on at least three non-highway or off-highway tires;
(4) Is designed for recreational use by one or more individuals;
(5) Has a seat or saddle designed to be straddled by the operator; and
(6) Has handlebars for steering control.
DIRT BIKE. Every two wheeled vehicle being capable of cross-country travel on natural terrain without benefit of a road or trail.
GO CART. Every motorized miniature vehicle capable of achieving speeds in excess often miles per hour and commonly used on courses or race tracks specifically designed for such vehicles.
SIDEWALK. Every part of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians located in the town.
STREET. Any public street, avenue, road, boulevard, highway, alley or other public place located in the town.

To protect the citizens of and visitors to the town, the use of ATVs, dirt bikes, and/or go carts is prohibited upon the public streets, alleys, and sidewalks within the town.

Establishment; function. The Town Council of the Town of Paoli hereby creates a Prohibited Vehicle Violation Fund which shall be a revolving fund, and all monies paid shall be placed in the fund and in no other place. The monies also shall not revert to the General Fund but shall remain in the Prohibited Vehicle Violation Fund. Any money generated from this fund can be used at the discretion of the Chief of Police.
