§ 70.99 PENALTY.
   (A)   Any person who violates any provision of this Chapter 70 shall, upon conviction, be subject to a fine not exceeding $2,500. A separate offense shall be deemed committed upon each day during which a violation occurs or continues.
   (B)   Any person who shall violate any provision of § 70.04 shall, upon conviction thereof, be fined $50 for the first violation. Second and subsequent violations will result in a fine of $100. In the event of a continuing or maintaining of a violation of any division of § 70.04, any person, firm or corporation causing or maintaining the nuisance shall upon conviction, be fined in a sum of $500.
   (C)   Any speed in excess of that codified in § 70.05 shall be unlawful and may result in an ordinance violation being issued against the driver of the vehicle with a fine issued in the amount of $50. The assessed fine shall be payable at the Paoli Police Department within 30 days in full satisfaction of the assessed penalty. In the event that such payment is not made within the period prescribed, and, at the discretion of the Police Chief and the Town Attorney, proceedings may be filed in the county court of competent jurisdiction. If found in violation of § 70.05, the violator shall be responsible for the $50 fine, court costs, interest, and attorney fees, if applicable. Funds generated from the assessed fines shall be placed in a fund to defray the expenses incurred by the town and the Paoli Police Department to defray the expenses of enforcing § 70.05.
