§ 70.04 GOLF CARTS, UTILITY VEHICLES, AND MOTORIZED BICYCLES.
   (A)   Definitions. For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      DRIVER’S LICENSE. A valid license to operate a motor vehicle issued by Indiana or any other state.
      FINANCIAL RESPONSIBILITY. Liability insurance coverage on licensed drivers of a golf cart, UTV, or motorized bicycle or unlicensed drivers of a golf cart, UTV, or motorized bicycle that are eligible for coverage on their parent or guardian's liability insurance in an amount not less than required by Indiana law for motor vehicles operated on public highways in the State of Indiana.
      GOLF CART. A vehicle with four wheels, originally designed for operation on a golf course and powered by a battery or internal combustion motor.
      MOTORIZED BICYCLE. A two or three wheeled vehicle that is propelled by an internal combustion engine or a battery powered motor, and if powered by an internal combustion engine, has the following: (1) An engine rating of not more than two horsepower and a cylinder capacity not exceeding 50 cubic centimeters; (2) An automatic transmission; and (3) A maximum design speed of not more than 25 miles per hour on a flat surface. The term does not include an electric personal assistive mobility device.
      UTILITY VEHICLE (UTV). A vehicle, generally motorized, that is designed for a specific task and popularly referred to as a “UTV”.
   (B) Registration.
      (1)   All persons operating a golf cart, UTV, or motorized bicycle within the town must have it registered annually with the Paoli Police Department.
      (2)   The annual registration form shall be completed in person at the Paoli Police Department between the hours of 8:00 a.m. and 4:00 p.m., Monday through Friday (excluding holidays).
      (3)   Such annual registration form shall require the: name of the owner; his/her address and telephone number; date of birth of operator; the make, model and serial number; and the color, size, and other identifying characteristics.
      (4)   Upon completion of registration form and payment of registration fee, the Paoli Police Department shall issue a registration decal which shall be on the vehicle in a location clearly visible. Such registration decal shall remain affixed to the vehicle at all times the vehicle is in operation within the town.
      (5)   The registration fee shall be $25. All registration fees shall be placed in a fund to be used by the Police Department.
      (6)   Paoli Police Department shall not issue the registration or decal until all required items are submitted and payment is made.
   (C)   Operation of golf carts and UTVs. Only persons over 16 years of age and have in their possession a valid driver’s license may operate a golf cart or UTV with the town.
   (D)   Operation of motorized bicycle. Only persons over 15 years of age and have in their possession a valid identification issued by the Indiana Bureau of Motor Vehicles.
   (E)   Financial responsibility. All operators of golf carts, UTVs, and motorized bicycles who are licensed to operate a motor vehicle in the State of Indiana or unlicensed operators of a golf cart, UTV, or motorized bicycle that are eligible for coverage on their parent or guardian's liability insurance are required to have liability insurance coverage in an amount not less than required by Indiana law for motor vehicles operated on public highways in the State of Indiana. Written proof of financial responsibility must be available either on the vehicle or on the person of the licensed operator at all times.
   (F)   Time of operation. Golf carts, UTVs, and motorized bicycles shall not be operated on city streets during one-half hour before sunrise to one-half hour before sunset, unless the with operating headlights (one for motorized bicycles and two, one on each side, for golf carts and UTVs) in the front, and operating tail lights with operating brake lights which are visible from a distance of 500 feet (one for motorized bicycles and two, one on each side, for golf carts and UTVs).
   (G)   Place of operation. 
      (1)   Golf carts, UTV’s, and motorized bicycles may be operated on city streets with a posted speed limit of 30 miles per hour or less.
      (2)   Golf carts, UTV’s, and motorized bicycles may not be operated on sidewalks, and may only be operated on highways to cross them at intersections in a path 90 degrees to such highways.
   (H)   Occupants.
      (1)   The number of occupants shall be limited to the number of persons for whom factory seating is installed.
      (2)   The operator and all occupants shall be seated with no part of the body extending outside the perimeter of the golf cart, UTV, or motorized bicycle.
   (I)   Traffic rules. The operator of the golf cart, UTV, and motorized bicycle shall comply with all traffic rules and regulations adopted by the state and the town that govern the operation of motor vehicles.
   (J)   Golf Cart, Utility Vehicle, and Motorized Vehicle Fund. Establishment; function. The Town Council hereby creates a Golf Cart, Utility Vehicle, and Motorized Vehicle Fund which shall be a revolving fund, and all monies paid shall be placed in the fund and in no other place. The monies also shall not revert to the General Fund but shall remain in the Golf Cart, Utility Vehicle, and Motorized Vehicle Fund. Any money generated from this fund can be used at the discretion of the Chief of Police.
