§ 53.04 FINE FOR DAMAGING METER READING EQUIPMENT.
   (A)   The Town Council of the Town of Paoli, Indiana shall be responsible for the administration of this subchapter.
   (B)   The Town of Paoli, Indiana shall charge the property owner the expense of the repairs and/or replacement of its meter reading equipment in an amount to be determined on a case-by-case basis by the Town of Paoli Clerk-Treasurer. The anticipated cost of current replacement (September 2016) is approximately $160.
   (C)   The Clerk-Treasurer, upon notice of damage to its meter reading equipment, will issue a notice of violation to the property owner and set forth the anticipated cost of repair and/or replacement to be charged to the property owner. Said notice may be hand delivered or sent via certified mail.
   (D)   A person who violates any provision of § 53.04 may, upon conviction, also be subject to a fine not exceeding $2,500, in addition to any enforcement processes contained in the subchapter.
   (E)   Any appeal of the repairs and/or replacement of meter reading equipment must be made in writing, within ten calendar days of the date of notice of the proposed repair and/or replacement, to the Town Council, which shall set the matter for hearing. The hearing may be at a special meeting of the Town Council or any regular scheduled meeting of the Town Council. After the hearing, the Town Council shall issue its written findings. Any appeal from written findings of the Town Council must be made to a court of competent jurisdiction located in Orange County, Indiana, within 60 calendar days of the issuance of its written findings by the Town Council.
