§ 51.99 PENALTY.
   (A)   Any person who violates any provision of this chapter for which no penalty is otherwise provided shall be subject to the penalty provided in § 10.99.
   (B)   (1)   Any person violating or suspected of violating § 51.02(B) shall be subjected to a penalty of $50 per month (or fraction thereof in which the violation occurs).
      (2)   A person may avoid payment of such penalty by consenting to an inspection described in § 51.04(J) for the purpose of establishing compliance with § 51.02(B).
      (3)   A person consenting to such an inspection and found in violation shall be given 90 days to comply with § 51.02(B) without being subject to a penalty.
   (C)   Any person who shall continue any violation beyond the time limit provided for in § 51.08 shall be guilty of a misdemeanor and in conviction thereof shall be fined in an amount not exceeding $500 for each violation. Each day in which any such violation shall continue shall be deemed a separate offense.
   (D)   Any person who violates § 51.36 is guilty of a Class A infraction.
