804.13 APPLICATION FOR CERTIFICATES; EFFECTIVE PERIOD.
   Regulatory certificates issued for all commercial and service activities shall be valid for one year following the date of issuance. All commercial establishments with buildings or premises in the Village shall file with the Village Clerk an application for the regulatory certificate to operate the commercial establishment in the Village. Such application shall be filed not later than April 30 of each year or at such time as the commercial establishment desires to commence operations in the Village. Application forms for all such documents shall be issued by the Clerk upon request.
   Subject to the provisions of this chapter, the Clerk, or such personnel as may be designated by the Clerk, shall issue the certificate after investigations by the Building, Fire and Police Departments, and by the Health Officer, where applicable, to permit the operation of the commercial establishment in the Village for a period of one year which shall begin on January 1 of the year for which such document is issued and shall terminate on December 31 of said year. All certificates shall be issued at the yearly rate of fees for the full regulatory year, provided that where such document is issued on or after July 1, the regulatory fee shall be one-half of the yearly fee for the unexpired term of the regulatory year. Recognizing that certificates issued for the May 1, 2003 through April 30, 2004 certificate year will have four (4) months remaining at the start of the January 1, 2004 through December 31, 2004 certificate year, the applicable fee for the January 1, 2004 through December 31, 2004 certificate year, as set forth in Section 804.14 below, shall be reduced by one-third (1/3) for any business holding a valid certificate at the time of application for the January 1, 2004 through December 31, 2004 certificate.
   The required fee for each certificate issued shall be collected upon application. In no event shall any rebate or refund be made of any regulatory fee, or part thereof, by reason of death or by any reason of non-use of the certificate or discontinuance of the operation of the commercial establishment or other commercial or service activity.
   If a commercial establishment moves its place of operation from one location in the Village to another location in the Village, the charge for a new regulatory certificate shall be the established prevailing rate for the new location, with due credit given for the charge for the original effective document.
   Regulatory fees for vending machines shall be applied to the individual machine and not to the business location. Such vending machines cannot be relocated within the Village without the issuance of a new certificate, upon notification of such relocation, in writing, to the Clerk.
