If a dog is found running at large, as provided in Section 608.03, and returned to its owner, no fee shall be assessed for the first violation if the dog is returned within one hour. However, if a dog has been returned more than once in a six-month period by police officers, such police officers may issue a citation to the owner for having an habitually stray dog.
