§ 155.01 RESTRICTIONS ON FILL USED.
   (A)   Before any fill is placed, the trees, stumps, and hedges from the entire area to be filled must be removed. Only fill can be used that will compact and develop a satisfactory stability. Sod, frozen material, or any matter which by decay or otherwise might cause settlement shall not be allowed. Crushed material, broken concrete, stones, or rocks shall be well distributed and sufficient earth or other fine materials shall be incorporated with them when they are deposited to fill the interstices. No stones, rocks, or broken concrete more than four inches in largest dimension shall be permitted within a vertical distance of 12 inches from the surface of the finished grade.
   (B)   Pieces of concrete not exceeding two square feet for any area of surface and large rocks and boulders may be placed in filled area without being broken up, provided they are well embedded and the interstices filled in such a manner as to give proper density.
   (C)   Violation of the foregoing restrictions on the use of fill shall result in a fine of $250 per day for each day improper fill is located on the premises. In addition, the land owner shall be responsible for the cost of removing any unlawful material located on the premises together with court costs and attorney's fees incurred by the city in connection with any civil or criminal actions.
