Open excavations or the removal of topsoil necessary or incidental to the construction or installation of buildings, structures, or other fixed works shall be excluded from the provisions of § 96.21. However, in the event the necessary or incidental excavations or areas of topsoil removal are not completely covered within a period of one year after commencing the excavation or removal of topsoil, then the excavations shall be made self-draining, or shall be backfilled within 30 days after notification as provided for in § 96.28.
