§ 113.01 SALE, EXHIBITION, DISPLAY OR POSSESSION; EXCEPTION.
   (A)   The exhibition, possession, sale, display or offering for sale of any squib, rockets, firecracker, torpedo, grenade or any combustible firework or aerial type fireworks is a nuisance and is prohibited within the city and within an area immediately adjacent and contiguous to the city limits and extending for a distance of 5,000 feet. This section shall not apply: to the sale of any such articles by wholesalers to each other; to the sale of any such articles at wholesale to retail merchants conducting business entirely within the city; or to the sale by wholesalers for private or public demonstration as provided in this section.
   (B)   Although the city has declared fireworks a hazard and/or nuisance, the city recognizes that fireworks cannot be curtailed due to national tradition and/or custom. Therefore, the city will allow the display, sale, use or possession of non-aerial fireworks in accordance with this section. A fireworks stand shall comply with the requirements of this section and with any applicable state or federal regulations and rules regulating fireworks.
