§ 91.41 NOTICE TO ABATE; CONTENTS.
   (A)   (1)   Whenever the existence of any nuisance, as herein defined, on any lot or parcel of real estate of property situated in the city shall come to the knowledge of the Code Enforcement Officer, it shall be duty of said city official to cause a written notice to be issued forthwith to the person owning or having possession or control of same, identifying such property and requiring said person to abate such nuisance by removing said weeds, brush, burned hulls, rubbish or other objectionable, unsightly, unhealthy, unsafe or unsanitary matter or whatever nature, as the case may be.
      (2)   The notice provided herein shall be in writing and either served personally or sent through the U.S. mail addressed to the owner of said lot, property or parcel of real estate, at his or her last known address, if said letter is returned unclaimed, or personal service has not be had, or if the owner’s address cannot be ascertained, the notice shall be published two times within ten consecutive days in the newspaper of general circulation with the city.
   (B)   (1)   The notice to the owner, tenant or to the person owning or having possession and control of a lot, property or parcel of real estate, where a public nuisance has been found to exist, shall contain the following items:
         (a)   A statement identifying said property;
         (b)   A statement requiring the abatement of such nuisance within ten days from the date of such notice;
         (c)   A statement notifying said person that they can appeal the determination of a public nuisance made by the Code Enforcement Officer with the City Manager within ten days from the date of such notice;
         (d)   A statement notifying said owner that if said public nuisance is not abated, nor an appeal with the City Manager is requested, within the ten-day period, the city will, after the expiration of the 14 days:
            1.   Cause, at once, the same to be done and charge the owner with the costs and expenses incurred in doing or having such work done; and/or
            2.   File a complaint regarding notice of violation of said ordinance with the Municipal Court in the city.
      (2)   If the owner of the lot, property or parcel of real estate is a governmental entity, said governmental entity shall have 30 days to abate such nuisance; and, if such is not abated, a complaint will be presented to the Municipal Court Judge.
