§ 91.39 DECLARATION OF NUISANCE.
   (A)   Whenever and wherever weeds, rubbish, burned hulls or any other objectionable, unsightly and unsanitary matter of whatever nature, covering or partly covering the surface of any lot or parcel of real estate within the city shall exist, or from any other cause shall be in such condition as to be liable to cause disease or produce, harbor or spread disease germs of any nature, or tend to render the surrounding atmosphere unhealthy or unwholesome or obnoxious, such condition is hereby declared to constitute a public nuisance, the prompt abatement of which shall be deemed a public necessity.
   (B)   It shall be unlawful and it is hereby declared a public nuisance for any person, including the owner, tenant or a representative of any non-resident owner, of any lot(s) or parcel(s) of real estate or part thereof, or any other premises where vacant or occupied with the city to allow all rank and uncultivated vegetation or brush to flourish.
