(A) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
WHOLESALE PURCHASER. Any municipality, water district and/or other provider of water service to the ultimate consumer of the water sold.
EMERGENCY. Any situation or event, natural or manmade, which impairs a wholesale purchaser's water supply reserve or system such that:
(a) There is a disruption of the normal water supply functions to the wholesale purchaser's customers; and
(b) In order to protect the public health, an immediate supply of water is necessary to meet the water needs of the wholesale purchaser's ultimate customers.
(B) Emergency wholesale water rate. The emergency wholesale rate for the sale of water by Paintsville Utilities to a wholesale purchaser shall be as follows: $2.50 per 1,000 gallons of water.
(C) Condition precedent for application of emergency wholesale water rate. In order for the above-stated emergency wholesale rate for the sale of water to apply, the City Council shall be provided with written confirmation from the Kentucky Public Service Commission or other appropriate state and/or federal regulatory agency that an emergency, as defined herein, exists.
(D) Rate when emergency conditions not met. Unless written certification of an emergency, as defined herein, has been provided so as to allow application of the emergency wholesale rate to apply for the sale of water to a wholesale purchaser, the applicable water rate as provided under § 54.02 of this code shall apply.
