§ 50.02  ACCUMULATION IN APPROVED CONTAINERS REQUIRED.
   (A)   No owner, tenant or lessee of any public or private premises shall permit to accumulate upon his premises any garbage or refuse except in covered containers approved by the Sanitary Inspector of the County Health Department or the Mayor.  Such containers shall be constructed of metal in such manner as to be strong, not easily corrodible, rodent proof, shall have a capacity of not less than 20 gallons, nor more than 30 gallons, which are covered with close-fitting lids, same to be in place at all times except when refuse is being deposited therein or removed therefrom.  Where practicable, all garbage shall be drained of liquids and wrapped in papers.  If one container is not sufficient to hold the quantity of garbage accumulated between collections, a sufficient number of containers shall be provided.  Boxes, papers, tree cuttings, and odd articles shall be bundled in lengths not to exceed five feet and not to exceed 50 pounds in weight.

   (B)   Before any person shall be found guilty for violating division (A) of this section, the Sanitation Supervisor for the city shall send notice by regular mail to any owner, tenant or lessee of any premises allowing garbage or refuse to accumulate upon premises owned, rented or leased by an individual, giving the individual 15 days from the date of the letter in which to remove garbage or refuse from the premises.

   (C)   The City of Paintsville shall offer garbage containers to its customers for monthly rental at a cost of $3 per month.
