929.10 SWIMMING POOLS.
   (a)    Any person who constructs, builds, assembles and/or installs either an in-ground or above-ground swimming pool shall be required to obtain a Pool Permit and register the pool with the Paden City Water Department. All pool owners shall pay an initial water fill-up fee based upon the following formulas:
 
      (1)    Rectangular Pools:    Width X Length X Average Depth X 7.5 = Volume Volume X 0.01 = Fee
      (2)    Round Pools:       3.14 X Radius X Radius X Depth X 7.5 = Volume
                  Volume X 0.01 = Fee
   (b)    If at any time it becomes necessary for the pool owner to completely drain the water from the swimming pool for purposes of maintenance and repair, the pool owner shall be required to pay another water fill-up fee based upon the formula set forth in Section 929.10(a).
   (c)    All water fill-up fees shall be paid in advance of filling or refilling the swimming pool with water from the City's water distribution system.
   (d)    Any swimming pools that are under ten (10) feet in circumference, do not require chemical water treatment or are sold to consumers without a pump or chlorination device shall be exempt from this Article.
   (e)    Any pool owner who fails to obtain a Pool Permit or fails to pay the water fill-up fee shall pay a fine in an amount not to exceed five hundred dollars ($500.00).
