§ 51.99 PENALTY.
   (A)   The owner or operator of any resources recovery facility, landfill or other refuse processing facility who fails to notify the town of the delivery of loads of solid waste originating from the town containing significant quantities of recyclable items, in violation of § 51.06, shall be subject to a warning for a first violation and the civil penalty of $500 for each subsequent violation.
   (B)   Any municipally registered hauler or other solid waste collector who dumps more than one cubic foot in volume of solid waste in an area not designated for disposal by the Board or who knowingly mixes other solid waste with items designated for recycling shall, for a first violation, be liable for a civil penalty of $1,000 and $5,000 for each subsequent violation.
   (C)   Any other person who violates any provision of this chapter shall be subject to the following penalties:
      (1)   Upon a first or second offense, the violator shall receive a written warning;
      (2)   Upon a third offense occurring within a period of one year from the date of the original offense, the violators shall be subject to a fine in the amount of $50; and
      (3)   Upon any subsequent offense occurring within the period of one year from the date of the original offense the violators shall be subject to a fine of $100 and, in addition, shall be refused recycling collection.
   (D)   Any municipally registered hauler who violates any provision of this chapter may in addition to the above-described penalties, be subject to license suspension or revocation in accordance with the procedures set forth in the solid waste ordinance, as codified in Chapter 50.
   (E)   In addition to the foregoing, the town may, at its expense, provide for the removal of recyclable items or other items of solid waste in order to abate any violation. Any cost thus incurred by the town shall be assessed against the person who caused the violation.
   (F)   Any revenues derived from fines, licensing fees or other enforcement action shall, unless otherwise required by law or the provisions of a federal, state or regional grant, be deposited into the town’s General Fund.
