731.08 NATURE OF GRANT.
   (a)   Authorization. This grant shall authorize a Franchisee to provide only cable service on the system.
   (b)   Noncable Services. This Grant does not authorize the Franchisee to provide any noncable services on the System other than described in Oxford Code Section 731.08(a) above. This grant specifically excludes telephone and data transmission service, and all other noncable services.
   (c)   Police Powers. The Franchisee's rights under this Grant are subject to the police powers of the City under the Charter of the City of Oxford and the laws and Constitution of the State of Ohio to adopt and enforce ordinances of general applicability necessary to protect the health, safety, and welfare of the public. The Franchisee shall comply with all laws, regulations, and ordinances existing or enacted by the City which are not specifically preempted by Federal or State law or by FCC regulation.
   (d)   City's Right to Install. The City shall have the right to install and maintain, free of charge, upon any poles and within any underground conduits of the Franchisee, any wires and fixtures desired by the City to the extent that such installation and maintenance does not interfere with the operations of the Franchisee.
 
   (e)   Property Rights. Nothing contained in this Chapter or in any Franchise granted hereunder shall grant any rights to use private property (except to the extent that such property is subject to a public easement) to the Franchisee. The Franchisee must obtain any necessary permission from the owners of such private property.
   (f)   Franchise Non-Exclusive. The Franchise granted herein is non-exclusive. The City specifically reserves the right to grant, at any time, additional Franchises for a System in accordance with city, state and federal law. In the event City should grant another cable television franchise, said Franchise shall not be on terms or conditions more favorable or less burdensome than those imposed herein.
