§ 152.01 WRITTEN PERMIT REQUIRED; FORM.
   (A)   It shall be unlawful for any person, firm or corporation to construct, erect, post, place, hang, display or maintain upon any street, alley, sidewalk or upon any city building, or upon a wall, fence, post or tree upon or adjacent to any street, alley or sidewalk, or over any street, alley or sidewalk in the city or upon a vacant lot or in any yard in the city unless placed a distance from the sidewalk equal to its length or height, whichever is greater, any billboard, signboard, sign, banner, poster or advertisement, without first having obtained from the city a written permit to do so.
   (B)   Said permits are not required to be in any particular words or form, but may be in substantially the following words and form:
 
Permit is hereby granted by City of Owenton, Ky., to            to construct, erect, post, place, hang, display and maintain a billboard, signboard, sign, banner, poster or advertisement, in the city in the following place and in the following manner: Upon it appearing and upon his or her representations that same is not be constructed of inflammable materials, or placed in the immediate vicinity of any exposed electric wires, will not constitute a fire hazard, or physical hazard, or endanger the health and safety of the general public, or become unsanitary, or insecure, or offensive to decency or public morals, and upon his or her assurances that he or she shall maintain same in the above manner, and will when its purpose is fulfilled remove same at once, and will, if same does become hazardous, dangerous, combustible, unsanitary, insecure or offensive to morals and decency, remove same at once or improve same so as to comply with the provisions hereof, with or without notice.
Failure to carry out the terms of the permit, or securing same upon false representations or issuances, shall be prosecuted by warrant, and may be fined, punished by suspension or revocation of license, and by fine, and City of Owenton may summarily remove any such billboard, signboard, sign, banner, poster or advertisement violating the terms of this permit or the provisions of Ordinance 152 of the City of Owenton.
This permit shall not dispense with the necessity of securing occupational license tax in such instances as are required by other ordinances of the City of Owenton.
