(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) Any violation of § 91.18 of this code shall be cited to the district court. Violations shall be deemed a misdemeanor and fined no less than $100 and no more than $250 for each offense. The penalty for failure to obtain a certificate of occupancy shall be the responsibility of the property owner.
(C) Violations of this chapter and other provisions as set out in other specified chapters of this code shall be subject to the following schedule of civil fines.
(1) If a citation for a violation of this chapter is not contested by the person charged with the violation, the maximum penalties below shall apply; however, the Board may waive any or all of a penalty for an uncontested violation, if in its discretion, the Board determines that such waiver will promote compliance with this chapter. The penalties listed below are for each day a violation continues, beginning on the first day after the ending date of the correction period given in the citation. A second offense is an offense that occurs within five years of the determination by the Code Enforcement Board of a prior offense. All others are those that occur within five years of the determination by the Code Enforcement Board of two or more prior offenses.
