§ 116.30 LICENSE REQUIREMENTS.
   Except as otherwise provided herein, all licenses issued under this subchapter are subject to the following conditions and limitations.
   (A)   Proof of licensing for the use of fireworks must be provided with the application or approval by the City Council at least one month prior to the event.
   (B)   The licensee shall be responsible for the conduct of the business being operated and shall at all times maintain conditions of order.
   (C)   All licenses shall have at all times a valid certificate of insurance issued by an insurance company licensed to do business in the state indicating that the licensee is currently covered for operation of the automobile race, tractor pull, demolition derby or any other motorized activity of a like nature held at the County Fairgrounds by a liability insurance policy. The minimum limits of coverage for such insurance shall be $1,000,000 combined single limit.
   (D)   Such insurance shall be kept in force during the term of the license and shall provide for notification to the city prior to terminating or cancellation. A certificate of insurance shall be filed with the city.
   (E)   The licensee hereunder shall comply with all license conditions and with all applicable laws and ordinances.
   (F)   Except as otherwise provided herein, all licenses issued under this subchapter are subject to the following conditions and limitations, except during County Fair week.
      (1)   No race, heat or event shall commence after 10:30 p.m.
      (2)   No race, heat or event shall continue after 11:00 p.m.
      (3)   All spectators, drivers and employees must be off the grounds or premises by 12:00 midnight.
      (4)   Each licensee shall deposit with the City Administrator $500 in certified check, cashier’s check or cash, with application for license, at least one week prior to the commencement of the event, to be forfeited at the rate of $500 for each one-half hour or portion thereof that any event commences after 10:30 p.m. or continues after 11:00 p.m.
   (G)   (1)   Special events on any weekday or weekends and displays of fireworks which are not on the calendar submitted with the application may be approved by the City Administrator on a case-by-case basis, at least one week in advance of the special event.
      (2)   Application for these events must be made on a form provided by the city and are subject to a special permit fee to be established from time to time by the City Council.
