(A) No person, firm, or corporation shall hereafter build, construct, or put any mobile home on any lot or parcel of land, public street, alley, or common within the corporate limits of the town, except in a duly and legally established mobile home park, as defined in division (B) below.
(B) For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
MOBILE HOME. Any vehicle, including the equipment sold as part of a vehicle, which is so constructed as to permit its being used as a conveyance upon public streets or highways by either self-propelled or not self-propelled means, which is designed, constructed, reconstructed, or added to by means of an enclosed addition or rooms in such manner as will permit the occupancy thereof as a dwelling for one or more persons, which is both used and occupied as a dwelling having no foundation other than wheels, jacks, skirting, or other temporary supports.
MOBILE HOME PARK. A mobile home park currently licensed by the state’s Board of Health.
(C) No person shall occupy a mobile home that has been placed on any lots or parcels of land, public street, alley, or common within the corporate limits of the town not specifically permitted by the terms of this section.
(D) Any peace officer of the town is hereby authorized and directed to issue an order in writing to any person, firm, or corporation found to be in violation of this section and a misdemeanor to remove said mobile home within 48 hours.

(A) All buildings and improvements located on real estate in the town, which are intended to be utilized for residential housing, shall be placed on, anchored, and attached to and incorporated onto a permanent, fixed, solid perimeter foundation.
(B) This section may be enforced by the town through the county courts.

MANUFACTURED HOUSING
(A) It is the intent of this subchapter to regulate and control the provision of alternative housing in general residential areas by permitting the use of manufactured homes, as defined in § 154.16, in all districts in which similar dwellings constructed on site are permitted, subject to the requirements and procedures set forth herein to assure acceptable similarity in exterior appearance between such manufactured homes and dwellings that have been or might be constructed under these and other lawful regulations on adjacent or nearby lots in the same district.
(B) It is the further intent of this subchapter to regulate and control the provision of alternative housing in certain areas by limiting the provision, placement, or use of manufactured dwellings, as defined in § 154.16, to a manufactured dwelling or mobile home park and to limit the provision, placement, or use of mobile homes to a mobile home park.

For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ANCHORING SYSTEM. An approved system of straps, cables, turnbuckles, chains, ties, or other approved materials used to secure a manufactured or mobile home.
ANSI/NFPA 501 A STANDARD FOR INSTALLATION OF (MANUFACTURED) MOBILE HOMES. Model national standards (including all authorized successor documents) for installation of manufactured and mobile homes, as adopted and copyrighted by the National Fire Protection Association and the Manufactured Housing Institute.
APPROVED. Acceptable to the appropriate authority having jurisdiction by reason of investigation, accepted principles, or tests by nationally recognized organizations.
FOUNDATION SIDING/SKIRTING. A type of wainscoting constructed of fire and weather resistant material such as aluminum, asbestos board, treated pressed wood, or other approved materials enclosing the entire undercarriage of the manufactured or mobile home.
MANUFACTURED DWELLING. A dwelling unit, built in a factory, which possesses or bears any of the following characteristics:
(1) Is single wide in design;
(2) Bears a seal of compliance with Federal Manufactured Housing Construction and Safety Standards, being 42 U.S.C. §§ 5401 et seq., and constructed after January 1981; or
(3) Is a transportable vehicle which is greater than eight feet in body width or longer than 36 feet in body length and designated and constructed as a single detached single-family dwelling unit, designed for long-term occupancy, to be transported, and arriving at site ready for occupancy.
MANUFACTURED DWELLING AND MOBILE HOME PARK. A parcel of land on which two or more manufactured dwellings or mobile homes are occupied as residences.
MANUFACTURED HOME. A dwelling unit fabricated in an off-site manufacturing facility for installation or assembly at the building site, bearing a seal certifying that it is built in compliance with the federal Manufactured Housing Construction and Safety Standards Code, as amended, and is:
(1) Constructed after January 1, 1981;
(2) Is double or multi-sectioned; and
(3) Exceeds 950 square feet of occupied space.
MANUFACTURED HOME SUBDIVISION. A parcel of land platted for subdivision according to all requirements of the comprehensive plan, designed or intended for lots to be conveyed by deed to individual owners for residential occupancy primarily by manufactured homes.
MANUFACTURED HOUSING CONSTRUCTION AND SAFETY STANDARDS CODE. Title VI of the 1974 Housing and Community Development Act (42 U.S.C. §§ 5401 et seq.), as amended (previously known as the federal Mobile Home Construction and Safety Act), rules and regulations adopted thereunder (including information supplied by the home manufacturer, which has been stamped and approved by a design approval primary inspection agency, an agent of the U.S. Department of Housing and Urban Development pursuant to HUD rules), and regulations and interpretations of said code by the state’s Administrative Building Council; all of which became effective for mobile and manufactured home construction on June 15, 1976.
MOBILE HOME. A transportable vehicle that is greater than eight feet in body width and longer than 36 feet in body length and designated and constructed as a detached single-family dwelling unit with all of the following characteristics:
(1) Designed for long-term occupancy and containing sleeping accommodations, a flush toilet, a tub or shower, bath and kitchen facilities with plumbing, and electric connections provided for attachment to outside systems;
(2) Designed to be transported after fabrication on its own wheels, on flatbed or other trailer, or detachable wheels; and
(3) Arriving at the site where it is to be occupied as a dwelling complete, including major appliances and furniture, and ready for occupancy except for minor and incidental unpacking and assembly operations, location on foundation supports, connection to utilities, and the like.
MOBILE HOME LOT. A designated site within a mobile home park or subdivision for the exclusive use of the occupants of a single mobile home, including mobile home slab, lawn, driveway, and parking area for said occupants.
MOBILE HOME PARK. A tract of land which has been developed with all necessary facilities and services in accordance with a development plan, meeting all legal requirements, and which is intended for the purpose of providing a site for five or more manufactured homes, manufactured dwellings, or mobile homes for human habitation, either free of charge or for revenue purposes, including any building, vehicle, or enclosure used or intended for use as a part of the equipment of such mobile home park.
MOBILE HOME SLAB OR FOUNDATION. The solid material upon which the mobile home rests, consisting of a continuous concrete slab or a permanent foundation.
OCCUPIED SPACE. The total area of earth horizontally covered by the structure, excluding accessory structures such as, but not limited to, garages, patios, and porches.
ONE- AND TWO- FAMILY DWELLING CODE. The nationally recognized model building code prepared by the Council of American Building Officials, adopted by the state’s Administrative Building Council (ABC) as mandated through P.L. 360, Acts of 1971, and which includes those supplements and amendments promulgated by the ABC.
PERMANENT FOUNDATION. Any structural system transposing loads from a structure to the earth at a depth below the established frost line without exceeding the safe bearing capacity of the supporting soil.
PERMANENT PERIMETER ENCLOSURE. An approved non-load-bearing perimeter structural system composed of a continuous solid or mortared masonry wall having the appearance of a permanent load-bearing foundation characteristic of site-constructed homes, designed to support the loads imposed and extending below the established frost line. A permanent perimeter structural system completely enclosing the space between the floor joists of the home and the ground.
RECREATIONAL VEHICLE. A portable vehicular structure not built to the federal Manufactured Housing Construction and Safety Standards Code (or the obsolete ANSI 119.1 Mobile Home Design and Construction Standard) designed for travel, recreational camping, or vacation purposes, either having its own motor power or mounted onto or drawn by another vehicle including, but not limited to, travel and camping trailers, truck campers, and motor homes.
SECTION. A unit of a manufactured home at least ten feet in body width and 30 feet in body length.
SPECIAL EXCEPTION PERMIT. A device for permitting a use within a district other than a principally permitted use.
SUPPORT SYSTEM. A pad or a combination of footings, piers, caps, plates, and shims which, when properly installed, support the manufactured or mobile homes.

(A) Permitted placement of manufactured homes. The establishment, provision, location, placement, and use of manufactured homes, as defined in § 154.16, as permanent residences or businesses shall be permitted in any zone permitting installation of a dwelling unit or business unit, subject to requirements and limitations applying generally to such residential or business uses in the district, and provided such homes shall meet the following requirements and limitations:
(1) The residence or building shall be double or multi-sectioned and have more than 950 square feet of occupied space;
(2) The residence or building shall be located on a building lot of at least 75 feet by 125 feet;
(3) The residence or building shall be compatible or similar in appearance with the site-constructed residences within the local area;
(4) The residence or building shall meet the appropriate exterior appearance standards as set forth in § 154.18; and
(5) The residence or building shall receive all required permits, including those issued by the town, and conform with the comprehensive plan and other ordinances of the county and the town.
(B) Location of manufactured dwellings and mobile homes in communities or parks. The establishment, provision, location, placement, and use of all other manufactured dwellings, as defined in § 154.16, as permanent residences or businesses shall be permitted only in a mobile home park, as defined in § 154.16, and shall meet the exterior appearance standards of § 154.18 and installation standards of § 154.19.
(C) Non-conforming homes. A manufactured dwelling or mobile home placed and maintained on a tract of land prior to the adoption of this subchapter, but in violation hereof, shall continue to be a legal non-conforming use. If the non-conforming use is discontinued, the land thereafter must be used in conformity with all provisions of this subchapter.
(D) Replacement of non-conforming homes. Thereafter, upon application to the Town Council and subsequent approval thereof, a manufactured dwelling or mobile home deemed a legal non-conforming use may be replaced within 90 days by a manufactured dwelling of newer age and better quality, and as long as said placement adheres to exterior appearance standards of § 154.18 and installation standards of § 154.19.
(E) Structural alteration. Due to its integral design, any structural alteration or modification of a manufactured or mobile home after it is placed on the site must be approved by the authorized County Building Administrator and the Town Council.

(A) Manufactured homes.
(1) Manufactured homes shall be classified as to acceptable compatibility or similarity in appearance with site-constructed residences, as follows:
(a) Manufactured homes shall have more than 950 square feet of occupied space in the double-section or larger multi-section unit;
(b) Manufactured homes shall be placed onto a permanent foundation;
(c) Manufactured homes shall utilize a permanent perimeter enclosure in accordance with approved installation standards, as specified § 154.19;
(d) Manufactured homes shall be anchored to the ground in accordance with the One- and Two-Family Dwelling Code and manufacturer’s specifications;
(e) Manufactured homes shall have wheels, axles, and hitch mechanisms removed;
(f) Manufactured homes shall have utilities connected in accordance with the One- and Two-Family Dwelling Code and manufacturer’s specifications;
(g) Manufactured homes shall have siding material of a type customarily used on site-constructed residences (see Approved Materials List); and
(h) Manufactured homes shall have roofing material of a type customarily used on site-constructed residences (see Approved Materials List).
(2) Manufactured homes meeting the foregoing standards and characteristics are permitted in residential, general business, local business, and light industrial areas within the town.
(B) Manufactured dwellings. Manufactured dwellings are permitted in manufactured dwelling subdivisions or parks if they meet the following standards and characteristics.
(1) Manufactured dwellings shall have more than 320 square feet of occupied space in a single, double, or multi-section units.
(2) Manufactured dwellings shall be placed onto a support system in accordance with approved installation standards, as specified in § 154.19.
(3) Manufactured dwellings shall be enclosed with foundation siding/skirting in accordance with approved installation standards, as specified in § 154.19.
(4) Manufactured dwellings shall be anchored to the ground in accordance with manufacturer’s specifications or the ANSI/NFPA 501 Installation Standards.
(5) Manufactured dwellings shall have utilities connected in accordance with manufacturer’s specifications or the ANSI/NFPA 501 Installation Standards.
