(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) Whoever violates § 91.01 shall be subject to a civil fine of not less than $50, nor more than $500. Each violation shall constitute a separate offense.
(C) Any violation of § 91.02 shall be punished by a fine of no more than $500 per incident as well as other penalty provided by this Code of Ordinances.
(D) In addition to the costs of abatement, said landowner is subject to a fine of up to $250 for a violation and an administrative fee of $250 of § 91.17.
(E) (1) In addition to the costs of abatement, the owner, user, or possessor of property shall be subject to a fine of up to $250 for a violation of § 91.30.
(2) In addition, said property owner shall be assessed a penalty of $100 per day of violating § 91.30(F).
(F) (1) If owner fails to bring the property into compliance with § 91.31 within the prescribed 15 days, either by the proper disposal or removal in a lawful manner from the corporate limits of the town or by the sheltering of said junk, said owner shall be subject to a fine of up to $2,500 and the town shall be entitled to seek and obtain a mandatory injunction from the County Circuit Court, pursuant to I.C. 36-1-6-4 for the purposes of requiring any person violating the terms of § 91.31 to remove in a lawful manner said junk found to exist on private property, and to seek enforcement of the payment of any penalty prescribed herein. In addition, if the town seeks enforcement of said section through the courts, all court costs and attorney fees incurred by said town shall be added to any penalty herein.
(2) The Clerk-Treasurer or the Town Attorney are hereby authorized to file said civil action for mandatory injunctive relief on behalf of the town.
(G) Any person, firm or other entity in violation of any portion of § 91.33 shall be subject to a civil penalty in the sum of $100 for each offense. Each day, or part thereof, that a violation continues in existence constitutes a separate violation for which civil penalties may be imposed. In addition to civil penalties, the appropriate enforcement officers of the town may seek injunctive relief.
