§ 30.32 COUNTY AREA PLANNING COMMISSION.
   (A)   Membership. In accordance with the provisions of I.C. 36-7-4-211, membership of the County Area Planning Commission shall hereafter consist of those members as set forth herein:
      (1)   Six county representatives designated as follows:
         (a)   The County Agricultural Agent;
         (b)   The County Surveyor;
         (c)   Two citizen members, each of whom is a resident of the unincorporated area of the county, appointed by the County Executive; and
         (d)   Two citizen members, each of whom is a resident of the unincorporated area of the county, appointed by the County Fiscal Body.
      (2)   Town representatives designated as follows: one member appointed by each of the following Town Councils, if the town is a participant in the County Area Planning Department:
         (a)   The Town Council of Versailles;
         (b)   The Town Council of Osgood;
         (c)   The Town Council of Sunman;
         (d)   The Town Council of Milan;
         (e)   The Town Council of Napoleon; and
         (f)   The Town Council of Holton.
      (3)   The total number of members depends upon the number of towns participating in the County Area Planning Department. The maximum number of members is 12.
   (B)   Appointment of citizen members, terms, and removal.
      (1)   The appointments of any citizen members from participating towns shall accompany the passage and approval of this section. After passage of this section, appointments shall be made in a timely manner, and for any town deciding to participate in the County Area Planning Department in the future, their appointment shall accompany their ordinance to participate.
      (2)   (a)   The initial terms of the citizen members of the County Area Planning Commission from the participating towns, the County Executive, and the County Fiscal Body shall be as set forth herein:
            1.   The citizen member appointed by the Town Council of Versailles: three years;
            2.   The citizen member appointed by the Town Council of Osgood: four years;
            3.   The citizen member appointed by the Town Council of Sunman: two years;
            4.   The citizen member appointed by the Town Council of Milan: three years;
            5.   The citizen member appointed by the Town Council of Napoleon: two years;
            6.   The citizen member appointed by the Town Council of Holton: one year;
            7.   The citizen members appointed by the County Executive: one year and four years; and
            8.   The citizen members appointed by the County Fiscal Body: two years and three years.
         (b)   Each member’s term expires on the first Monday of January of the first, second, third, or fourth year, respectively, after the year of the member’s appointment.
      (3)   When an initial term of office of a citizen member expires, each new appointment of a citizen member is for a term of four years. A member serves until his or her successor is appointed and qualified. A member is eligible for reappointment.
      (4)   In accordance with the provisions of I.C. 36-7-4-218(f), the appointing authority may remove a member from the County Area Planning Commission for cause. The appointing authority must mail notice of the removal, along with written reasons for the removal, to the member at his or her residence address. A member who is removed may, within 30 days after receiving notice of the removal, appeal the notice to the county’s circuit court. The court may, pending the outcome of the appeal, order the removal or stay the removal of the member.
   (C)   Vacancies. If a vacancy occurs among the members of the County Area Planning Commission, the appointing authority shall appoint a member for the unexpired term of the vacating member.
