(a) The Director of Public Safety and Service and the Director of Utilities, or their designees, may make any contract, purchase supplies or material to provide labor for any work under the supervision of their respective departments and divisions and agencies of the City involving not more than the following amounts:
Director of Public Safety: Fifteen thousand dollars ($15,000.00); and Director of Utilities: One hundred thousand dollars ($100,000) on all purchases other than annual purchases, and fifty thousand dollars ($50,000.00) on all annual purchases.
(b) When an expenditure with the department, division or agency other than compensation of persons employed therein, exceeds the above limits, such expenditure shall first be authorized and directed by resolution of Council. Except as otherwise indicated in this section (Section 155.02
), when so authorized and directed, the General Board of Control and/or the Public Utilities Board of Control, or their designees, shall make a written contract in the name of the City with the lowest and best bidder after advertisement for no less than two, nor more than four consecutive weeks in a newspaper of general circulation within the City.
(c) Upon the approval of a resolution by the Council, the General Board of Control and/or the Public Utilities Board of Control, or their designees, may enter into a contract without competitive bidding for any one of the following conditions:
(1) When such purchase consist of supplies or a replacements or supplemental part or parts for a product or equipment owned by the City and the only source of supply for such supplies, part or parts is limited to a single source of the Public Utilities Board and/or any director recommends to Council that the best source is the original manufacturer;
(2) When only a single sole source exists for the purchase of a particular item of equipment;
(3) When the contract is for a professional or technical service;
(4) When a General Services Administration (GSA) price and specification is certified to the City by the vendor, and the specification meets the needs of the City;
(5) When purchase through participation in state contracts into which the Department of Administrative Services, Office of State Purchasing has entered;
(6) When Council has authorized a contract to be competitively bid and no meaningful bids are received, the General Board of Control and/or Public Utilities Board of Control may proceed to award a contract as specified in the resolution without bidding; and
(7) When the contract is for the sale of real estate intended for economic development purposes.
(d) In the case of an emergency arising in connection with the operation and maintenance of various City departments, divisions and agencies, or when the Public Utilities Board recommends that work be performed at the power plant should be done under the General Presidents’ Project Maintenance Agreement by contract, Council may by a two-thirds vote of the members thereof, authorize the General Board of Control and/or the Public Utilities Board of Control, or their designees, to enter into a contract for work to be done or for the purchase of supplies or materials without formal bidding and advertising.
