8-1-1: DEFINITIONS:
For the purpose of this Chapter, the following terms, phrases, words and their derivatives shall have the meanings given herein. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. Words not defined herein shall be given the meanings ordinarily applied to such words.
COLLECTOR: Wherever herein used, shall mean the person holding a license or contract with the City, or employed by the City, and thereby authorized and designated by the City to collect, handle, transport and dispose of refuse and wastes.
DEBRIS: The remains, fragments, pieces or parts of something broken down, damaged or destroyed.
GARBAGE: Includes all putrescible waste, except sewage and body waste, including waste accumulated of animal food or vegetable matter, and including waste that attends the preparation, use, cooking, dealing in or storing of meat, fish, fowl, fruit and vegetables, and shall include all of such wastes or accumulations of vegetable matter of residences, restaurants, hotels and places where food is prepared for human consumption.
The term "garbage" shall not include recognized industrial byproducts.
INSPECTOR: The authorized employee of the City or some individual designated by the Council as having the duty of the enforcement of this Chapter.
LITTER: "Garbage", "refuse" and "rubbish" as herein defined and junk and all other waste or discarded materials and substances including, but not limited to, paper, bottles, glass, nails, tacks, hoops, cans, wire (barbed or otherwise), building materials and fixtures, electrical materials and fixtures, sand and gravel and roofing and siding materials, automobile parts and components and tires.
OWNER AND OCCUPANT: Wherever herein used, may be used interchangeably, and shall mean every person in possession, charge or in control of any dwelling, flat, rooming house, or any eating place, shop, place of business, manufacturing or business establishment where garbage or other refuse is created or accumulated.
PARK: A park, playground, recreation center or any other public area in the City owned or used by the City and devoted to recreation.
PERSON: Any person, firm, partnership, association, corporation, company or organization of any kind.
PRIVATE PREMISES: Any nonpublicly-owned property, whether used for residential, commercial, industrial or professional purposes, whether inhabited or temporarily or continuously uninhabited or vacant, and shall include any yard, grounds, walk, driveway, porch, steps or mailbox belonging or appurtenant to such property.
PUBLIC PLACE: Streets, sidewalks, boulevards, alleys or other public ways and public parks, squares, spaces, grounds, easements and buildings.
REFUSE: All putrescible and nonputrescible solid waste (except body waste), including garbage, rubbish, trash, ashes, street cleanings, dead animals, abandoned automobiles, junk and solid market and industrial waste.
RUBBISH: A nonputrescible solid waste consisting of both combustible and noncombustible waste, such as paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, bedding, crockery and other similar materials.
The term "rubbish" shall not include recognized industrial byproducts.
VEHICLE: Every device in, upon or by which any person or property is or may be transported or drawn upon a street, except devices moved solely by human power or used exclusively upon stationary rails or tracks.
WASTE: Unwanted solid, liquid or gaseous materials. (Ord. 476, 10-16-1974)
