§ 155.03 SPECIAL SITUATIONS.
   (A)   Off-street parking. One wall graphic may be displayed on the side or rear of a building adjacent to an off-street parking area if the off-street parking area is 40 feet or more in width.
   (B)   Multiple frontages. If a building has frontage on, or access to, two or more public streets or highways, each side of the building is to be separately considered for purposes of determining compliance with the provisions of this chapter and the Appendix, Table of Basic and Auxiliary Design Elements. Area allowances for street graphics may be utilized only on the side of the building from which they are calculated.
   (C)   Special advertising signs in business, office, and manufacturing zoning districts.
      (1)   During grand openings or other special events, one additional sign adhering to the basic ground and wall restrictions may be erected on a temporary basis.
      (2)   Special use signs will be temporary in nature and shall be classified as Type A and Type B signs.
      (3)   (a)   Type A signs shall not exceed 4 four-day periods per calendar year.
         (b)   Type B signs shall not exceed 1 forty-five-day period per calendar year.
      (4)   (a)   Type A signs shall not exceed 32 square feet in area.
         (b)   Type B signs shall not exceed 50 square feet in area.
         (c)   Types A and B signs shall have no moving parts, flashing lights, or illumination.
      (5)   Items of information or advertising shall not exceed ten items and shall pertain to the grand opening or other special event on the property or location that the sign is placed on.
   (D)   B-2 special use motor vehicle sales lot signs.
      (1)   Special signs (pole or flag design) will be allowed on lighting poles in vehicle sales lots.
      (2)   These signs are limited to a maximum size of 15 square feet each and not more than two double or single face signs per pole, containing a maximum of five items of information per sign. The signs shall have no moving parts or operating flashing lights.
      (3)   Signs shall be attached to the light poles in a safe and secure manner. When those signs show deterioration, as determined by the Building Commissioner, they shall be replaced.
      (4)   Signs being replaced shall be the same size, material, color, and lettering. If not, a new permit will be required for those new signs.
      (5)   Permit fees for B-2 special use motor vehicle sales lot pole signs shall be $10 for each single face sign and $20 for each double face sign.
   (E)   Outdoor sales, advertising signs, and promotional devices.
      (1)   Outdoor sales of merchandise prohibited. Sales of goods, wares, items, merchandise, or services shall not be permitted outside of structures located on the premises, except as follows:
         (a)   Zoning districts. Zoning districts which are approved for outdoor sales of goods, wares, items, merchandise, or services that are accessory to indoor establishments and special uses, located on the same premises.
         (b)   Special outdoor sales.
            1.   Special outdoor sales are defined as temporary outdoor sales of goods, wares, items, merchandise, or services which are customarily sold inside the structure located on the property by the business located on the property.
            2.   Multi-business organizations (shopping centers or strip centers) shall engage in outdoor sales as a multi-business organization and not individually.
            3.   The outdoor sale shall not exceed 3 four-day periods per calendar year.
         (c)   Garage sales and yard sales.
            1.   Garage sales and yard sales are permitted only in residential districts. The sales shall be limited to the possession of homes within a radius of 500 feet of the dwelling unit where the garage or yard sale is being held.
            2.   Permit Required, Fee: The owner or occupants of the residence shall apply to the Police Department for a permit at least twenty-four (24) hours prior to beginning a garage or other like sale. A permit fee in the amount of five dollars ($5.00) shall be paid at the time of application.
            3.   Number of Permits and Duration of Sale Restricted: No more than three (3) permits shall be issued for any residence during one (1) calendar year and no sale shall be allowed to continue for more than three (3) consecutive days.
            4.   Types of Items to be Sold: The items to be sold at a garage or other like sale shall be items of personal property, including but not limited to, household goods, clothing and furnishings which have been used in the dwelling unit located on the premises where the sale is to be conducted. Sale items purchased for intentional sale or resale may not be sold at such sale.
            5.   House of Sale: No garage or other like sale may commence before the hour of nine o'clock (9:00 a.m.) extend beyond the hour of six o'clock (6:00 p.m.).
            6.   No sidewalk or public parkway shall be obstructed as a result of a garage or other like sale.
            7.   Posting of Signs Prohibited: Posting of garage or other like sale signs on utility poles, parkway trees or other public property is prohibited. Violation of this prohibition shall be punishable in accordance with the penalty provisions of this case.
      (2)   Permit required. A permit shall be required for all special outdoor sales of goods, wares, items, merchandise, or services and special advertising signs and promotional devices except for residential garage and yard sales.
      (3)   Application for issuance of permit.
         (a)   An application form requesting a permit shall be applied for by the owner/manager of the business and shall identify the nature of merchandise to be sold, the days and hours of the sale, and outdoor area where the merchandise is proposed to be sold or such other information as the Building Commissioner shall require to show full compliance with this and all other codes and ordinances of the village.
         (b)   Permit approval will be based on the adequacy of parcel size, parking provisions, traffic access, and the absence of undue adverse impact or other properties and compliance with all other codes and ordinances of the village.
      (4)   Special advertising signs and promotional devices.
         (a)   In conjunction with applying for an outdoor sales permit, applicants may apply for a permit for special advertising signs, balloons, flags, banners, pennants, and promotional devices to be displayed at the time of the outdoor sales period on the property where the business is located.
         (b)   A maximum of ten items of information on special advertising signs, banners, flags, balloons, pennants, and promotional devices are allowed.
      (5)   Permit fees.
         (a)   The fees for outdoor sales, signs, balloons, flags, pennants, banners, and promotional device permits, and inspections shall be as follows:

         (b)   Signs, banners, flags, and balloons that are beyond the sizes above, shall be classified as promotional devices and the fee shall be $100 each.
   (F)   B-2 Automobile special promotional program uses.
      (1)   Retail automobile dealers, within the corporate limits, shall be authorized to advertise and hold no more than 14 special promotional programs per calendar year. No one special promotional program shall last more than four days in duration.
      (2)   Each special promotional program may include such things as:
         (a)   Additional special signage, within reasonable limitations.
         (b)   Inflatable devices, within acceptable standards.
         (c)   Beacon search lights, during hours of operation and in reasonable numbers.
         (d)   Special attractions (clowns, jugglers, petting zoos, animal rides, etc.).
      (3)   Other special promotional program variances may be granted by the authority of the Building Commissioner and Village Administrator; without special notice or hearing. Such variances may include such things as: duration of the special promotional program, number of special promotional programs or content of the special promotional program.
      (4)   All special promotional signs, inflatable devices, beacon search lights and other promotional items or devices installed shall be designed and constructed in conformance with the provisions for materials, loads and stresses of the current village adopted edition of the BOCA National Building Code.
      (5)   Permit fees for B-2 automobile special promotional program uses shall be:
