§ 93.25 DUMPING PROHIBITED.
   (A)   No person, firm, or corporation shall dump, deposit, place, leave, or cause to remain any debris, garbage, abandoned or discarded property, dirt, fill, building materials, or other materials of any nature upon any public or private real property within the village, except when such is being used for the filling, back filling, leveling, grading, construction upon, or landscaping of that real estate upon which a permanent building has been or is being constructed, or except within an enclosed area designed for such purpose upon real estate which is zoned to permit such a use.
   (B)   When such material or debris is being used for the filling, back filling, leveling, grading, or landscaping of real estate, the material must be leveled and graded to the top of any foundation located on the lot; or to curb level if no foundation exists, or to a grade established by the village. This leveling must occur within 72 hours of the original deposit of the material. These regulations do not affect construction excavations as regulated in § 93.15.
