The following regulations cover all regular employees except full-time sworn law enforcement personnel. Official disciplinary action is designed to correct unacceptable behavior. Each disciplinary action should increase in severity for repeated offenses. The following steps should be taken, though any of the steps can be taken at any time, depending upon the severity of the offense:
(A) Oral warning. An oral warning may be given for an offense. The employee's supervisor or another higher authority may issue the warning. The verbal reprimand shall include a warning that if the actions continue, a written reprimand will follow.
(B) Written warning. The warning should include filling out an employee warning report. The employee, the supervisor and the Village Administrator shall each receive a copy. (See Appendix G following this chapter). All of the above mentioned people should sign and date the original copy, which shall be placed in the employee's personnel file.
(C) Suspension. The department head, with approval of the Village Administrator, may suspend an employee for up to 30 days, depending on the nature of the offense.
(D) Discharge.
(1) An employee who ignores previous verbal and/or written warnings, or who commits any offense described in § 35.090, may be discharged.
(2) No employee shall be discharged by the village except at the direction of the Village Administrator, with the advice and consent of a majority vote of the Board of Trustees then holding office. Prior to discharging any employee, the Village Administrator shall give notice to the employee, and provide the employee with a reasonable opportunity to be heard in his or her defense before the Board of Trustees.
(3) The Village Administrator shall report to the Board of Trustees, in writing, the reasons for the employee's discharge not less than seven days after the discharge.

The following are examples of possible causes for disciplinary action. The list is not inclusive, and is meant as a general guide to avoid misunderstandings:
(A) Release of confidential information.
(B) Insubordination, or failure to perform an assigned task.
(C) Discourtesy or use of abusive language.
(D) Conviction of a felony.
(E) Falsification of organization records or reports.
(F) Willingly making a false statement to a supervisory official, the public, or to any village board or commission.
(G) Theft or unauthorized use of village tools, machinery or reports.
(H) Immoral conduct or indecent behavior on village premises.
(I) Violation of village ordinances, administrative regulations, or department rules.
(J) Violation of, or disregard for an established safety practice.
(K) Recklessness, carelessness or negligence in the handling or control of monies, property, village vehicles, or equipment.
(L) Repeated convictions of misdemeanors and/or traffic charges during employment.
(M) Being tardy and/or absent without proper authorization.
(N) Misuse of sick leave and/or other benefits.
(O) Provoking, instigating or participating in an activity intended to disrupt the established work routine.
(P) Gambling on the premises.
(Q) Ingestion, introduction, possession or use of intoxicating liquors or drugs on village property, or reporting for or being at work while being under the influence of alcohol or a controlled substance.
(R) Failure to properly report accidents or a personal injury.
(S) Physical or mental unfitness for the performance of duties.
(T) Refusal or neglect to pay just debts due the village.
(U) Inability to work amicably with other village employees.
(V) Engagement in outside business activities or part-time employment on village time.
(W) Incompetency or inefficiency in the performance of duties.
(X) Brutality or cruelty to a person in custody, provided the act committed was not necessary or lawfully done in self-defense, or to protect the lives of others, or to prevent the escape of persons lawfully in custody.
(Y) Conduct unbecoming an employee of the village, whether on-duty or off-duty.
(Z) Conviction of a misdemeanor involving immoral behavior.
