105.01 ESTABLISHMENT OF HARBOR LINE.
   Council hereby establishes that the harbor line from the shore of the Municipality is two miles out from the shore line, more specifically described as follows:
   Situated in the State of Ohio, County of Lucas and being an area and acreage to be obtained under submerged waters starting from a point known as Little Cedar Point on the east and extending west 21, 120 feet to a point directly north of station 41-1, and south from station 41-1 to Bay Shore Drive or shore line, and extending east following the shore line to the point of North Curtice Road, extending north to line 202 and following the shore line northeast to the point known as Little Cedar Point, all area being in the Maumee Bay of Lake Erie.

105.02 MUNICIPAL CONTROL AND AUTHORITY OVER HARBOR.
   (a)   All piers, docks, wharves, connecting ways, places, tracks, contained disposal facilities and all other structures and improvements together with all buildings and appurtenances necessary or incidental to such uses located in the portions of the Maumee River, Maumee Bay and Lake Erie within the City or within two miles from the natural shoreline of Lake Erie, whichever is further shall be under the control of the City which shall exercise such control in the manner prescribed in subsection (c) hereof.
   (b)   No person, corporation, partnership, joint venture or other entity including the State or any of its political subdivisions or instrumentalities or agencies shall construct, operate, place, maintain, lease, use, install or exercise control over any of the structures which are subject to the control of the City pursuant to subsection (a) hereof without the prior approval of the City as set forth in subsection (c) hereof.
   (c)   All jurisdiction of the City under this section shall be exercised in the aid of navigation and water commerce by ordinance adopted by Council subject to the rights of the U. S. Government and the public rights of navigation and fishery in such area.
