1529.03 DEFINITIONS.
   For the purposes of this chapter, the words and phrases defined in the sections hereunder shall have the meanings therein respectively ascribed to them, unless a different meaning is clearly indicated by the context. Where terms are not defined herein, the ordinarily accepted meanings within the proper context shall apply.
   (a)    "Substance" means any element, entity, compound, combination or any mixture thereof, whether organic or inorganic.
   (b)    "Trace quantity" means a quantity of a substance which constitutes less than one percent (1%) of the total substance or the total volume of the substance in question.
   (c)    “Hazardous chemical" means, except as provided in Section 1529.02, a substance in commercial use listed in the list of substances contained in part 1910, Subpart Z of Title 29 of the Code of Federal Regulations, Table Z-1 through Z-3 thereof, which have been found to be hazardous chemicals and which represent a significant risk to the public health and safety as a result of foreseeable use, handling, accidental spill, exposure or contamination. "Hazardous chemical" shall not mean any substance which contains only a trace quantity of a hazardous chemical.
   (d)    "Chemical name" means the scientific designation of a chemical in accordance with the nomenclature system developed by the International Union of Pure and applied Chemistry or the Chemical Abstracts Service Rules of Nomenclature.
   (e)    "Common name" means any designation or identification, such as trade name or number or code name or brand name, used by the employer to identify a chemical other than by its chemical name.
   (f)    "CAS Number" means the identification number assigned by the Chemical Abstracts Service to chemical substances.
   (g)    "Container" means any receptacle or formed or flexible covering for toxic or hazardous chemicals including but not limited to: bag, barrel, bottle, box, can, cylinder, drum, carton, stationary or mobile storage tank, vessel or vat.
   (h)    "Fire Chief" means the Chief of the Fire Department, the Chief of the Fire Prevention Bureau of the Fire Department or a member of the Fire Department designated by the Chief of the Fire Department to carry out the duties and responsibilities set forth herein.
   (i)    "Label" means written, printed and graphic information displayed or affixed to the container of a chemical.
   (j)    "Store" means to deposit or place a chemical in the City for a period of forty- eight hours or more.
   (k)    "Work area" means any room or defined space, whether within or outside of a building or other structure, where chemicals are used, manufactured or stored, and includes, but is not limited to, areas where chemicals are handled, mixed, processed, packaged, repackaged or transported and where employees or others are likely to be present.
   (l)    "Workplace" means an establishment or business at one geographic location containing one or more work areas.
   (m)    "Employer" means any person, firm, corporation, partnership, association or other entity engaged in a business or in providing services who or which has employees, but does not include the United States or the State of Ohio and any of its political subdivisions. The term "employer" also does not include the employment of domestic workers or casual laborers employed at the place of residence of the employer.
   (n)    "Employee" means any person who works, with or without compensation, in a workplace.
   (o)    "Material safety data sheet" means that listing of information as required in Section 1529.06.
