(a) Every employer manufacturing, reclaiming, disposing, using or storing a hazardous chemical in a workplace within the City shall compile and make available to the Fire Chief on request a material safety data sheet for every hazardous chemical which appears in its workplaces within the City. The material safety data sheet shall set forth the following information:
(1) The chemical name, trade name, common name and CAS number and any other commonly used name of the substance;
(2) The routes of exposure such as inhalation, ingestion, adsorption or absorption;
(3) The symptoms of and acute and chronic effects of exposure to chemical at hazardous levels;
(4) The potential for flammability, explosion and reactivity of the chemical;
(5) Appropriate emergency treatment in the event of exposure to hazardous levels;
(6) Proper conditions for safe use and exposure to the chemical, including the need for personal protective equipment and type thereof needed;
(7) Procedures for cleanup of leaks and spills of the chemical including emergency procedures for fire and explosion,
(8) The name, address and the current telephone number of the manufacturer, vendor or source.
(b) The employer shall provide a secure location at each workplace approved by the Fire Chief which shall be accessible to the Fire Department at all times and in which shall be maintained current copies of all material safety data sheets required by this Chapter to be kept by the employer.
(c) The employer shall retain material safety data sheets required under subsection (a) hereof for a period of at least one year after the hazardous chemical was last used, manufactured or stored in its workplace.
(d) For chemicals which entered a workplace prior to the effective date of this section for which the employer has not received a material safety data sheet, the employer shall make a reasonable effort to obtain such data sheets. For chemicals which enter a workplace after the effective date of this section if material safety data sheets provided by the manufacturer are incomplete, or if the manufacturer fails to provide the material safety data sheets, the employer shall make all reasonable efforts to obtain information to complete the material safety data sheets. If an employer has made such an effort, but has failed to receive such information he shall not be deemed to be in violation of this chapter upon notification to the Fire Chief of his efforts.
